“There would be concern about the lack of an autonomous entity as required by this treaty, and we would be in a situation of violation. In addition, there would be additional concerns from operators who would like to come to the country to do business,” Bautista told Expansión.
This situation would mean a setback in the progress that had been achieved externally, according to Cynthia Solis, co-founder of the Lexinf legal firm and member of the IFT Advisory Council.
“In the short term, the disappearance of this type of organization would bring a lack of certainty of the rule of law, but also of social justice, because beyond regulating companies, the work of this type of organization is also to defend many of the rights of the users,” said Solís.
Sheinbaum announced that José Antonio Peña Merino will be the director of the government’s Digital Transformation Agency, an organization that he will head as of October 1. Although there has been no talk of the disappearance of these organizations, specialists agree that one of the main challenges of the new institution and its owner will be technical experience.
“There are several scenarios around what could happen now that a new reform arrives. The first is that of its disappearance, but a second is that the vacancies that exist in the IFT can be filled by some of the politicians of this type of organization and thus the technical talent of the organization, the commercial agreements and a more dialogue would be maintained. bilateral,” said Bautista.
In addition, Merino faces a challenge in terms of cybersecurity, since it would be necessary to define whether a possible National Cybersecurity Strategy would fall under this agency, and its definition includes issues not only of digitalization, but also fiscal and prosecutor’s offices, among others.
Within the work of entities such as the INAI, this new entity should also focus on personal data and its regulation, so that the digital rights of citizens are not violated, according to the legal specialist.
For his part, Ernesto Piedras, director of The CIU, pointed out that the work of this type of entity helps balance the markets, attract new players and protect the personal finances of users, so the focus would have to be to continue with this path of economic competition and not eliminate them.
