The PSOE will resume the processing of the Land Law that it has already agreed with the PNV starting in September, and trusts in an agreement with the PP to approve the norm after Sumar, Podemos, Esquerra Republicana (ERC) and Junts rejected the text that the Ministry of Housing proposed in a project.

The Government’s idea is to wait until that month because that is when the PP is going to present its Land Law in the Senate. From then on, the Government will see what points can be negotiated to reach a text that satisfies the socialists and the ‘popular’, according to parliamentary sources confirmed to Europa Press.

To begin with, the PP has already said that its law will also affect the Housing Law and will eliminate the rent cap that was included in it, something that a priori will not like a Ministry of Housing that has defended that cap to lower prices. in stressed areas.

Where there may be consensus is in relation to the cascading nullity in urban planning, that is, that a correctable error does not imply the collapse of the entire urban planning project as occurs with current legislation.

PSOE AND PP WANT TO END THE NULLITY CASCADE

The Deputy Secretary of Sustainable Development of the PP, Paloma Martín, indicated that the PP law would guarantee that a cascading nullity does not occur in the planning, while the PSOE and PNV law proposal establishes stricter criteria to avoid this event. The reform of Congress also proposes the partial nullity of the planning instruments when this can be individualized to a territorial area or other specific determinations.

For her part, the Minister of Housing and Urban Agenda, Isabel Rodríguez, has already publicly urged the PP to support the reform of the Land Law in several control sessions in Congress, alleging that it is a norm that businessmen and women are demanding. the real estate sector throughout Spain.

This means that there are two scenarios for the processing of the law: one in which the PSOE and PNV norm is accepted for processing so that amendments to the articles of the different groups can be included later; or the PP norm is approved in the Senate and is sent to Congress to continue its processing in the same way.

SUMAR AND PODEMOS ARE AGAINST THE LAW

Those who will not like either of the two laws are Sumar and Podemos. Both parties already rejected the original bill and the ‘purple’ party even presented an amendment to the whole to return the text to the Government.

It was not the only amendment in its entirety, since ERC and Junts also presented theirs. This caused, together with the lack of support from the minority partner of the Executive and the unknown position of the PP, that the Government withdrew the project from the agenda when the three amendments in their entirety were going to be debated, just before the elections. European elections on June 9.

Once the electoral storm had passed, the PSOE reached an agreement with the PNV to present a joint law that is practically the same original text, with the exception that now the instruments of territorial and urban planning have to be governed “in the terms that the regional regulations provide”. Likewise, the new wording says that these instruments may be “modified or replaced” in the terms established by the regional regulations.

THEY TRUST IN CATALAN SUPPORT

With these regional safeguards, the Executive trusts that ERC and Junts will join in supporting the law, as it considers it necessary to give oxygen to the town councils that are facing lawsuits from offices specialising in appealing urban planning for minor errors.

The Ministry of Housing and Urban Agenda explained in the draft of the project that was sent to Congress, and to which Europa Press had access, that this limit on complaints would serve to stop “blackmailers” who take advantage of the regulations. in force to present complaints before urban planning that they later end up withdrawing after reaching an economic agreement.

The department headed by Isabel Rodríguez stated that the current law has produced “clear abuses” in the exercise of these claims, especially in large cities. Thus, the aim of the reform is to provide legal certainty to urban planning and prevent correctable formal errors from leading to the total nullity of territorial and urban planning instruments.
