The trans-Andean justice pointed out that Patricio Maturana, former head of the carabineros, was responsible for throwing a tear gas grenade in the head of the now legislator, who lost three senses and suffered severe damage to the skull, during mobilizations in October 2019. The sentence will be known next month, but the Western Prosecutor’s Office requested 12 years in prison.
This Wednesday, September 1, the San Bernardo Oral Court ruled against the former Carabineros captain, Patricio Maturana, in the case involving him for the crime of unlawful coercion resulting in serious injuries against Fabiola Campillani for an event dating from November of 2019.
The carabinero leader was unanimously found guilty of shooting the now national senator with a tear gas unit that hit her in the head, causing her to lose her sight, taste and smell, leaving severe consequences and significant damage to the skull.
“His intention was not to use the weapon to disperse or dissuade the crowd, but rather his purpose was to harm,” Judge Marcela Nilo said regarding the action that took place in San Bernardo during the social outbreak.
Nilo added that the policeman “acted without need, without proportional use of force, without obeying the protocols themselves, without helping the victim, with abuse of his position.”
In addition, the magistrate explained that the circumstances in which the event occurred did not warrant such action by Maturana. It was at a time when the protesters were at a far distance and without causing incident.
In the resolution they explain that the former police officer “exposed” Campillai to serious injuries due to his responsibility and destroyed his “life project by ignoring the circular on the use of force, the protocols for maintaining public order and the operations manual.”
The sentence will only be known on October 10. The Western Prosecutor’s Office asked for 12 years in prison, according to prosecutor Paola Zárate.
However, the court ruled out the possibility of adding possible aggravating circumstances because they understand that all of them are included in the current case. While they highlighted the outstanding previous career of Maturana as a carabinero.
After the aggression suffered, one of the most iconic examples of the violence applied by the government of Sebastián Piñera in the 2019 protests, Campillai increased his popularity to the point that he reached the Senate as elected in the first majority, independently, without political support of any party.
For his part, Maturana was discharged by the militarized police for not providing help to the victim. He was arrested on August 28, 2020 for this trial that began on May 10 of the current.
