The Provincial Court of Madrid will decide within two months on the appeals by the Public Prosecutor’s Office and the defence of Begoña Gómez requesting that the case against the wife of the President of the Government be closed. In a ruling issued on Tuesday, to which elDiario.es has had access, the president of Section 23, Rosario Esteban, sets the deliberation and ruling on the aforementioned appeals to the higher court, Judge Juan Carlos Peinado, for 30 September.
These appeals by the Public Prosecutor’s Office and Camacho’s defence were submitted on 7 and 8 July directly to the Provincial Court, which accelerated the procedure. If they had been appeals for reform, the judge’s likely rejection would have made them take even longer to reach the higher court, which will finally resolve them within a period of 11 weeks.
Following the presentation of these appeals, the Public Prosecutor’s Office and Begoña Gómez’s defence have appealed the indictment of businessman Juan Carlos Barrabés and the summons of the President of the Government as a witness. The functioning of the Provincial Court indicates that these latter will be resolved after 30 September.
Therefore, if Peinado does not decide not to take Sánchez’s statement in Moncloa next Tuesday, the Provincial Court’s position on whether or not he should do so will be known approximately in October, at least two months after the event has taken place.
On July 7, the Public Prosecutor’s Office appealed to the Provincial Court of Madrid to put order in the “procedural drift” that Judge Juan Carlos Peinado. The Public Prosecutor’s Office considers that Peinado is ignoring the limits that the Provincial Court itself imposed on him in the investigation, which is giving a “very broad” dimension to the case without clarifying its true motives and which continually acts through “generalities”, with a “lack of specificity” that prevents the person under investigation from exercising “a dignified defense”. The Economic Crime Section spoke in its appeal of a “general case” against Gómez.
For his part, Begoña Gómez’s lawyer requested on July 9 that the case be dismissed because it had become a “universal investigation” against her. In the appeal filed, to which elDiario.es has had access, Gómez’s lawyer denounced that Peinado has undertaken a case on “the life and work” of the wife of the President of the Government in what amounts to a “prospective” investigation expressly prohibited by law.
