After a first moment in which he tried to act as a barrier in the tax fraud of Isabel Díaz Ayuso's partner, alleging that the crimes of Alberto González Amador were a private matter, the Madrid president's chief of staff, Miguel Ángel Rodríguez, has decided to personally take on the defense of the commission agent. For several weeks now, the senior official of the Community of Madrid has leaked false and interested information to imply that the Treasury investigation that began in 2022 is part of the Pedro Sánchez Government's persecution of Díaz Ayuso.
Rodríguez was the person who promoted the false news published by El Mundo, according to which it had been the prosecutor in the case who had proposed an agreement to Alberto González Amador that had been frustrated by “orders from above”, in reference to the heads of the Public ministry. This damaged merchandise was published by El Mundo on the front page on Thursday, March 14, two days after elDiario.es uncovered the case. The hoax had been spread by Miguel Ángel Rodríguez himself, who sent it to a dozen media outlets. Although the media that contrasted Rodríguez's message did not publish it, some press ended up making headlines with that false news.
The next morning, the Madrid Prosecutor's Office released a public note with a chronology about the case in which the owner of El Mundo denied and clarified that the agreement of conformity and the mutilated email that Miguel Ángel Rodríguez distributed between the Prosecutor's Office and the defense by González Amador was actually the last in a series that Ayuso's partner had started on February 2 and in which he admitted fraud. “Two crimes have certainly been committed against the Public Treasury,” the defense of Díaz Ayuso's partner wrote to the Prosecutor's Office that day.
Alberto González Amador ended up denouncing the Prosecutor's Office for revealing secrets and the Superior Court of Justice of Madrid will decide whether to admit it to proceedings.
Meanwhile, Miguel Ángel Rodríguez, who at the beginning of the case avoided answering the questions posed by elDiario.es because he was a “private citizen who has nothing to do with the Community of Madrid”, continues with his propaganda operation. In the last installment, he alludes to an alleged return that the Treasury plans to make to Alberto González Amador, for which he did not initially provide any clue. According to the newspaper El Mundo, this return has to do with a payment of 622,000 in corporate tax that González Amador made in fiscal year 2022, after the Treasury found tax fraud in the 2020 and 2021 returns. Therefore, it has no relationship with the years investigated, but has to do with a subsequent statement when González Amador already knew that the Tax Agency was hot on his heels. The return for the 2022 financial year has no influence on the crimes that the Prosecutor's Office reported last February in court, no matter how much Díaz Ayuso and his propaganda apparatus try to make it appear that it is the Treasury that owes money to his partner. This is a statement after the reported exercises and when González Amador already knew that he was being investigated and that false invoices had been detected.
Despite this, in the statements sent to some media, Ayuso's chief of staff states: “If the Prosecutor's Office denies the agreement, it will be for political reasons, not technical ones.”
The meaning of the leak is to show that it is the Prosecutor's Office, following instructions from the Sánchez Government, that is avoiding reaching an agreement. The emails that the defense of Ayuso's couple have exchanged with the Prosecutor's Office, and whose first leaker was Miguel Ángel Rodríguez himself, do not point to that but rather the opposite. The agreement of conformity was proposed by González Amador and the prosecutor in the case, as is usually done in this type of crimes, was open to the agreement.
Rodríguez's propaganda hides that any agreement can only occur on the basis of recognition of the crimes. This is not a discrepancy with the Treasury over amounts, as the president and her communication team try to make believe, the complaint from the Prosecutor's Office and what González Amador himself has already recognized in that email are crimes punishable by between one and six years in prison. In other words: any compliance agreement will imply the conviction of Ayuso's partner, at least for tax fraud. In the complaint filed in court he is also accused of falsifying documents.
Although Rodríguez tries to make it believe that the fraud of Ayuso's partner is a Government makeup operation to deal with the corruption network in which Koldo García, the former advisor of José Luis Ábalos, was arrested, the Treasury report shows that The inspection began in May 2022, many months before the operation in which the former minister's collaborator was arrested became known.
The Tax Agency file arises when it is found that there is a taxpayer who declares three times less profits after having multiplied the company's income by six. That taxpayer is Alberto González Amador, who saw his income skyrocket after taking a hit of two million as a commission agent between a Catalan company and another managed by his boss in Quirón, Fernando Camino, for the sale of medical supplies.
The sources consulted by elDiario.es assure that the procedure to agree on compliance in a tax crime is scheduled and consists of four steps. First, it requires recognition of the crime by the person who committed it and payment of the amount defrauded plus the surcharge and late payment interest, as civil liability. The next thing is to formulate a joint document between the accused, the Prosecutor's Office and the State Attorney's Office, which acts on behalf of the Tax Agency, establishing the sentence (usually a financial fine – between one and six times the amount defrauded – and penalty). of prison, which is usually commuted to financial fines).
That three-party agreement has to be executed by a judge, the person qualified to decide if it is valid. Contrary to what Miguel Ángel Rodríguez claims, conformity does not prevent the trial, which ends in conviction, although it would save Díaz Ayuso's partner from the so-called news punishment: having to appear, having the movements of their companies, that their alleged front men, experts, witnesses appear… Accepting the sentence, as González Amador has already done, would avoid all those procedures that could be broadcast by the media.
Fraud certified, that is now the main objective of Miguel Ángel Rodríguez, who week after week, invents a new smokescreen while Ayuso and her government try to avoid the conclusion of the case: the president of Madrid lives in a luxury apartment paid for by a confessed tax fraudster. And she enjoys a penthouse right above her, which is in the name of a company managed by the lawyer who represented her partner before the Treasury and that no one has explained how to pay for it.
While this is happening in full view of the entire world, Miguel Ángel Rodríguez continues improvising propaganda deliveries to distract attention: one week it is hooded journalists attacking Díaz Ayuso's home, the next alleged hackers launching cyber attacks against the lawyers of the partner of the president of the Community of Madrid and whose sophistication can only be achieved by the states… and now that it is the Treasury that is indebted to Alberto González Amador. The same González Amador, whose lawyer wrote to the prosecutor's office on February 2, long before the first line about this case was written: “Two crimes have certainly been committed against the Public Treasury.”
