Podemos has also rejected the tax formula because it wants a tax

The Congress of Deputies will debate and vote on January 22 on the decree that includes a new temporary tax on energy companies for 2025, a measure that PP, PNV and Junts do not support, whose votes are crucial for the rule to go ahead.
It was in the last Council of Ministers of the year when the Government approved this new tax for the year 2025, as promised to ERC, Bildu and BNG. And, although the rate was already applied last year, it was repealed with the entry into force of the tax reform, which included a provision at the request of the PP for that purpose. This clause managed to prosper in the Cortes due to the support of PP, PNV and Junts.
The new tax includes bonuses for companies that invest in “essential” activities for the ecological transition and decarbonization and with the commitment to convert it into a tax that the provincial treasuries can manage.
Specifically, it has a maximum bonus of 60% on the amount of the tax for those companies that make strategic investments that will have to be evaluated by the Ministry of Ecological Transition.
THE GOVERNMENT DECIDES WHICH INVESTMENTS ARE STRATEGIC
These investments can range from the production of renewable hydrogen to transforming waste into products that have a second life or into renewable gases, such as biogas.
Likewise, they will have to be part of a strategic investment plan for the ecological transition and, to apply the tax credit, the energy companies obliged to pay this tax will have to request from the Ministry for the Ecological Transition and the Demographic Challenge a reasoned report on whether the Investments included in the plan meet the consideration of strategic investments.
The department led by Sara Aagesen must notify, within three months of receiving the request, the corresponding reasoned report, which will be binding on the Tax Administration. After the period of three months has elapsed without any notification, it will be understood that silence is negative.
JUNTS REJECTS THAT THE GOVERNMENT IS THE ONE WHO DECIDES INVESTMENTS
And precisely that it is the Government that decides which investments are strategic or not is something that Junts rejects. Those of Carles Puigdemont have also been rejecting the tax because it could put at risk large investments in Catalonia, such as the 1.1 billion that Iberdrola plans to invest in Tarragona for a petrochemical project.
For his part, the PNV spokesperson in Congress, Aitor Esteban, has already said that on the part of his party “the vote is no” considering that the rate “breaks the principle of relations with the regional communities, both with the autonomous community Basque as with Navarra”, since being a tax it is not allowed for them to manage and collect it.
It also remains to be seen what Podemos will vote for, which has repeatedly rejected the tax formula because it wants a tax.
