The captain of the sailing ship ‘Bayesian’, which sank on August 19 off the coast of Sicily, in an incident that left seven dead, has invoked his right not to testify at his first hearing before the Public Prosecutor’s Office, which is examining his possible responsibility in the shipwreck.
Briton James Cutfield is charged with manslaughter over the incident, the causes of which are unclear. Although it occurred during a storm, investigators suspect human error may have led to the sinking of the luxury boat, owned by tycoon Mike Lynch.
Cutfield has broken down in tears before the prosecution and has avoided making a statement, according to sources cited by the AdnKronos agency. His lawyers claim that he is still in shock over what happened and that they need more time to prepare a defence, given the seriousness of the crimes that have been put on the table from the outset.
The captain is not under any precautionary measure that would prevent him, among other things, from leaving Italy and returning to Spain, where he lives with his family. It is also not ruled out that the investigation could be extended to other crew members, in particular Cutfield’s number two, Tijs Koopman.
