( Spanish) — The undersecretary of Human Rights, Population and Migration of the Mexican government, Alejandro Encinas, assured this Wednesday that a judge had formally sentenced three soldiers, including retired general José Rodríguez Pérez, for their alleged participation in the disappearance of 43 students from Ayotzinapa in 2014.
According to publication of the official on his verified Twitter account, Rodríguez is accused of the crime of organized crime.
is trying to contact the court to confirm this measure and obtain a copy of the resolution, as well as the defense of Rodríguez and a captain and a corporal who, according to Encinas, are also accused of organized crime and forced disappearance.
The official did not say when the trial against the accused will begin.
On September 15, the Undersecretary of Public Security of Mexico, Ricardo Mejía, reported at a press conference on the arrest of three soldiers in the case, among them who on September 26, 2014 was “the commander of the 27th Infantry Battalion when the events in Iguala arose”, in reference to the then Colonel José Rodríguez Pérez.
A spokesman for the Ministry of the Interior then confirmed to that Rodríguez Pérez is retired with the rank of general.
In accordance with Mexican legislation, the formal imprisonment order is a sentence issued by a criminal judge taking into consideration that the preparatory statement has been taken, that the corpus delicti and probable responsibility are proven, and that there is nothing that exempts of responsibility to the accused or that may end the procedure, such as death, amnesty or abandonment of the accusation, among other reasons.
