Nintendo will have to face a lawsuit from a company that accuses the Switch of being a plagiarism

Nintendo Switch has been a global success thanks to great games and a concept that turned out to be a breath of fresh air in the world of consoles. Nintendo may be very happy about that, but what it may not be so happy about is that it will have to face accusations from a company that claims the Switch is ripped off.

You may remember that, in 2020, a company called Gamevice accused Nintendo of plagiarizing their Wikipad device for the creation of the Nintendo Switch. Specifically, the company believes that the design of the Switch and that the detachable concept of the Joy-Con is a violation of copyright that belongs to the Wikipad, a controller designed to play on tablets.

The court recently dismissed Gamevice’s accusations, so Nintendo could sleep easy. That said, a California district judge decided to reopen the case to further investigate and determine if the 5 patents that Gamevice mentions were in fact violated by Nintendo in the creation of Nintendo Switch.

Judge Richard G. Seeborg’s argument is that the claims were not properly studied. This means that Nintendo’s lawyers will once again have to get down to business to defend the company in court.

Although this represents extra work for Nintendo’s legal team, in reality everything seems to indicate that it has the upper hand. After all, the plagiarism arguments were previously found to be invalid, and that will most likely happen again. However, it will be worth keeping an eye on to see how this situation evolves.
