Argentine President Javier Milei announced on Tuesday the end of the use of the Gender Law by prisoners with the aim of obtaining transfers to other prisons to enjoy more favorable detention conditions.
The announcement was made at the Casa Rosada, the headquarters of the government, within the framework of a ceremony to hand over sabers to a class of commissioners, commanders and prefects of the security forces.
“In recent weeks, several cases have become known of criminals who, using the Gender Identity Law, tried to argue that they were actually women who should be in a women’s prison, either to take advantage of female inmates or to continue with those negotiated, from more lax conditions,” declared Milei.
He added that “this stupidity ends. We are going to prohibit it, because criminals will not be able to request a change of prison under the umbrella of gender identity. And we are going to promote an initiative so that the provincial prison systems can adhere.”

Cantero, leader of a powerful drug trafficking gang in the city of Rosario, about 300 kilometers northwest of the capital. Last week, Milei said, Cantero filed 10 habeas corpus requests in court to identify himself as bisexual and thus be able to receive visits from men. Cantero has been sentenced to 113 years for various crimes and is being held under a strict security regime.
“Only in a country whose values have been deeply disrupted can such atrocity be allowed,” Milei argued.
Meanwhile, days before, the case of a prisoner for gender violence who was transferred to a women’s prison in the central province of Córdoba had become public after declaring in court that he perceived himself as a woman. Once in his new destination, he was accused of raping a fellow prisoner.
During the event Milei also provided strong support to the security forces who “have demonstrated with honor and courage to rise to the circumstances that the times demanded of them.”
He added that “for many years in this country, politics tried to put the perpetrators in the place of the victims and the victims in the place of the perpetrators” in a “ridiculous argumentative struggle” in which the security forces “were left helpless.” ”.
The president added that “the absurdity of releasing prisoners was reached,” as happened during the COVID-19 pandemic to avoid infections in prisons and “punish honorable police officers for the unforgivable crime of doing their job well.”
