Law that suspended the expiration of driving licenses falls

In the last few hours, the Plenary Chamber of the Constitutional Court overturned the law that suspended, for a maximum of two years, the expiration of driving licenses expiring between January 1 and 31, 2022.

This was an incentive, through the Article 11 of Law 2161 of 2021, with which people could have additional time to renew their license. However, when studying the lawsuit, the high court said that it was unconstitutional but deferred the effects of its decision, which will only take effect after June 20, 2023.

Likewise, the Court justified that it seeks to allow citizens to renew their licenses and there is no collapse in the renewal of driving licenses like the one recorded in 2014.

The decision was unanimous and was made with a presentation by Judge Cristina Pardo.

The statement was made regarding a lawsuit filed by Johan Pacheco Charris who argued that this license expiration suspension it was included in Congress only until the fourth debate of the bill, for which a principle called “flexible identity” was violated.

Along with this, he argued that the measure is not related to the law in question, that is, the regulation of the Compulsory Traffic Accident InsuranceSOAT.

In the middle of the discussion, the attorney had requested to leave things as they were by indicating that the extension of the validity of driving licenses was indeed associated with the main subject of the law, including incentives for citizens aimed at improving road safety through the modification of the provisions of the National Land Traffic Code.
