Israeli Justice authorizes indefinitely retaining corpses of “terrorists” for exchanges

The Israeli Supreme Court has unanimously approved authorizing the Government to retain the bodies of alleged “terrorists” to negotiate possible exchanges, including those of Israeli citizens.

Last year, up to six complaints were filed by relatives of the deceased against the retention of the bodies, with which they could not receive burial, alleging “serious and flagrant damage” to the dignity of the deceased and their families.

The Government argued that the negotiations for the release of the hostages held in the Gaza Strip are “dynamic” and delicate, so “it cannot be ruled out that the possession of the bodies of these terrorists is necessary to achieve the return of the captives and missing”.

The ultra-conservative judge David Mintz, responsible for drafting the opinion of the three judges involved, has alleged the “limited scope” of the Supreme Court to address Government decisions on security issues, which is only conceivable in “extreme situations”, according to what he states. ‘The Times of Israel’.

Mintz points out that the military command has the authority to hand over the bodies or retain them based on a 1945 norm. He also highlights that the measure is “provisional and limited in time” and that given the current situation “we do not consider that there is room for our intervention.
