Begoña Gómez asks the judge if her secret investigation is what the Madrid Court prohibits her from doing

The defense of Begoña Gómez has filed an appeal before the court of Juan Carlos Peinado in which they ask the magistrate if the facts that he is secretly investigating are the same as those that the Provincial Court of Madrid, the instance higher than him, left out of the investigations. because either they were a hoax or they were “mere conjectures.”

In the appeal, to which elDiario.es has had access, Gómez’s lawyer affirms that Judge Peinado “seems to be implying that he is investigating those blocks that the Court considered did not meet the elements that would allow in a State of Law to open the investigation”. And he adds about the resorted providence: “But he doesn’t do it clearly either.”

“Under these conditions and with serious impairment of the right to effective Judicial Protection of my client, it is impossible to know what the Court considers to be the subject of investigation in this case. Especially if we take into account that she is summoned to testify in a few days about facts of which she is unaware,” the appeal continues.

From the complaint presented by Manos Cleans, based on seven published information and a hoax, the Provincial Court left out “two blocks”, referring to the false award of a subsidy to Gómez and his alleged participation in the rescue of Air Europa. The third block, regarding contracts with European funds obtained by a company owned by businessman Juan Carlos Barrabés, the judge had to recuse himself in favor of the European Prosecutor’s Office.

Once, Peinado transferred to the European body the only block on which he could investigate, there was no more material with which to obtain instruction. But the judge reported that he was continuing, which prompted a letter requesting clarifications from the defense of the person under investigation. The popular accusations that Peinado has allowed to appear in the case, among them Vox, Manos Médicas or a lawyer assiduous of denialist theses, have attempted to expand the investigation with writings in which they present facts that can be investigated. But Judge Peinado has not ruled on the matter.

The lawyer, in the appeal that the judge must resolve, appeals to the Criminal Procedure Law, the Supreme Court and an order from the State Attorney General’s Office on the obligation that the judge has to inform, even in a generic way, of the object of his investigation to the aforementioned.
