However, at that time the regulatory body did not carry out any action because at the same time the creation of a new unit within the CMA specialized in supervising internet companies was under discussion, but this never came and the investigation around Apple’s dominance in the mobile market was interrupted.
Subsequently, in June 2022, the CMA pressed again to initiate an investigation of the mobile ecosystem where it again showed its concerns regarding the market power of Apple and Google, which it published in November, where it also highlighted its concern for other sectors, like that of video games in the cloud.
However, by then it was too late according to the Court of Appeals, which said that the CMA documents “lack the legal prerequisites (publishing a timely notice and beginning an opportunity consultation) for a valid decision.” about”.
