Petro continues without powers to intervene in public services

The State Council maintains firm the decision to suspend the draft decree so that President Gustavo Petro assumes functions of the Creg, after an attempt by the Government to annul it.

The high court had already provisionally suspended Decree project 227 of February 16, 2023 presented by the Government for the president to assume functions of the Energy and Gas Regulation Commission (Creg). With this new decision, he ratifies his position and for now the president will not be able to intervene in public services.

The initial idea of ​​the Government was to provide “some of the Presidential functions of a regulatory nature in the matter of home public services and other provisions are issued”, initiative that was presented and issued by the President of the Republic, the Ministers of Finance and Public Credit; Housing, City and Territory and Mines and Energy; and the Director of the National Planning Department.

The decree allowed the president to resume the general functions delegated to the commissions for three months. This includes those such as the establishment of the tariff methodology.

For their part, the commissions would have particular functions, that is, those that include specific issues related to companies.
