The new General Telecommunications Law enters into force: Goodbye to unwanted Telephone Spam



Today, June 29, 2023, the new General Telecommunications Law in Spain with different regulations that affect the operation of telephone and internet networks in our country.

One of the novelties that most affects “ordinary” users is that companies are prohibited from making commercial calls without the users’ consent. In case you do, may be reported to the Spanish Agency for Data Protection or AEPD to initiate an investigation and the consequent sanction, whether it is a Spanish or foreign company.

In this way, companies can only call if they have been given prior permission (either when signing a contract or giving them our data), and they always have to give the option to cancel that consent if they have received it.

This prohibition applies both to calls from switchboards with a landline phone, to calls made from mobile phones, a strategy used by many operators to make spam calls without being blocked.

Additionally, the new General Telecommunications Law determines that mobile phone number portability must be carried out within 1 business day, and obliges all operators to improve access to their services for people with disabilities or special needs.

Likewise, personal data will be protected more effectively and more information will be offered about the cookies stored when browsing the Internet.
