How many times have you been on the highway and asked yourself: can I overtake on the right if the driver on the left does not leave his lane despite going slower than me? You are not alone, it is a very recurrent issue.

Because 14% of Spaniards suffer from “left lane syndrome”, there are times when we are forced to overtake on the right. This can be tricky. Let’s see when you can overtake on the right without legal problems:

  • The vehicle you want to overtake indicates your intention to turn left or stop.
  • On traffic routes in both directions, to trams that run through the central area.
  • Within a town, on roads with at least two lanes in the same direction, as long as it is done without endangering other users.
  • On a road with several lanes, outside of a town, if due to traffic circumstances, the right lane moves faster than the left lane. This occurs, for example, in retentions.

Outside of all these circumstances, overtaking on the right is always prohibited. First for being dangerous, and second for being illegal according to the DGT. Because yes, because doing that has a sanction of a few zeros.

If we talk about the fine, overtaking on the right can carry a penalty of up to 200 euros, which is no joke. Luckily it is not a sanction that costs points on your driving license, so if you are unlucky enough to be sanctioned, don’t worry, you will only have to pay and nothing else.
