Is it a mere ‘boomerang effect’ that a Supreme Court today dominated by conservative judges decrees the abolition of the federal law that authorized abortion in 1973, when the same court was dominated by progressive judges? “No,” answers constitutional lawyer Rafael Peñalver from Miami and explains why it is a decision that harms democracy in that country.
The sentence with which the judges of the current Supreme Court of the United States annulled the federal law that authorized abortion by 6 votes against 3 is highly criticized by Rafael Peñalver.
“When you read the judgment (on Roe v. Wade) of 2022, it seems like a political speech by Trump and not a decision of the Supreme Court of the United States. The Supreme Court depends totally on the prestige and on the citizenry accepting the decision of a supposedly apolitical panel of people who are elected to that position for their personal ability and integrity,” says Peñalver.
