Ukraine proposes the creation of a Special Court to punish Russia

After the Russian invasion of his country, the president of Ukraine affirmed this Wednesday before the high-level debate of the General Assembly that a crime has been committed against his nation and that for this reason he demands a fair punishment for what he considers “a robbery of his territory”.

“The crime was committed against our state borders. The crime was committed against the life of our people. The crime was committed against the dignity of our women and men. The crime was committed against the values ​​that make you and me a United Nations community,” Volodymyr Zelenskyy warned during a pre-recorded video message.

The Ukrainian president considers that the punishments should be produced “for the murders of thousands of people”, “for the torture and humiliation of women and men” and “for the catastrophic turmoil” that Russia has caused in Ukraine and worldwide.

Consequently, he presented a formula with five conditions that fit any country that suffers the same consequences as Ukraine:

  • criminalize the crime
  • protect life
  • Restore security and territorial integrity
  • Guarantee the security
  • Set the resolve to fight back

Proposal to establish a Special Court

Among the forms of punishment he proposed sanctions, the blockade of trade and relations with Russia and the creation of a Special Court.

“We have prepared the precise steps to establish such a Court. They will be presented to all States. Ukraine will appeal to the UN General Assembly to support an international compensation mechanism. We count on your support,” she explained.

He claimed that “Russia must pay for this war with its assets,” which would be a terrible punishment for Russian officials “who value money above all else.”

Provide necessary help for Ukraine

Regarding the protection of the lives of the Ukrainians, he considered that, if help is required with weapons or projectiles, they must be provided; if financial aid is needed, it should be given; or that, if intelligence data is needed, it has to be delivered.

“We can return the Ukrainian flag to our entire territory. We can do it with force of arms. But we need time. We try to speed it up. We try to apply the basic provisions of the UN Charter for Ukraine through negotiations”, he explained.

However, he stated that “Russia is afraid of real negotiations and does not want to fulfill any fair international obligations. She lies to everyone. As is typical of aggressors, of terrorists.”

Restrict the prices of Russian energy resources

Regarding security and territorial integrity, he pointed out that maritime protection and food security are already being restored and that, despite the difficulties caused by the war, they sent humanitarian aid to Ethiopia and Somalia and plans to send more shipments of wheat.

Instead, he indicated that more difficult with other elements related to security and gave as an example the bombing of the Nuclear Power Plant of the South of Ukraine, located near the city of Yuzhnoukrainsk.

To solve the current cost of living crisis, which has its origin in the destabilization of the energy market, he proposed to eliminate “the main factor of the world price turmoil, namely: Russian energy blackmail. It is necessary to limit the prices at which Russia exports its energy resources”.

“Russian oil and gas must be brought back into the mainstream. Currently, oil and gas are Russia’s energy weapons. And that is why it manipulates the markets so that electricity, gas, gasoline and diesel become the privilege of a few instead of being a common good available to all, ”he stressed.

Better security guarantees through multilateral treaties

Regarding security guarantees, he claimed to have proposals “to improve the security architecture for Ukraine, and for Europe and the world”, through legally binding multilateral and bilateral treaties.

“Each one of you, who will receive the text of our peace formula, will also see the details of what we offer as security guarantees. I do not want to compare our offers with the guarantees of the alliances that now exist on the planet. I want to underline that it is always much better to guarantee the security of a nation, in a preventive way, than to stop a war when it has already started”.

He stated that the fifth point of the Ukrainian peace proposal is firmness.

“Something without which the other four points will not work. This is our determination to fight. This is the determination of the partners to help us, and also of themselves. And this is the determination of the world to unite around those who fight against armed aggression and to call to order those who threaten everyone”, he stated.
