They admit a lawsuit against the CAR for the expansion project of Av. Boyacá

The Council of State admitted the lawsuit filed by the Ministry of the Environment against the Regional Autonomous Corporation of Cundinamarca (CAR) by the Boyacá Avenue expansion projectin Bogotá.

The act seeks the annulment of the environmental license approved by the CAR to carry out the extension of this road corridor for the section between streets 183 and 235 in the north of the capital. This would pause the development of the project that was already financed and contracted.

The lawsuit also requests that Fiduciaria Bogotá SA, administrator of the Lagos de Torca Trust and holder of the license, be included as an interested party in the outcome of the process.

The Council of State opened a period of 30 days so that both the defendant and the third party with a direct interest can “answer the claim, propose exceptions, request evidence, call as collateral and, where appropriate, present a counterclaim.”

Likewise, it is ordered that during this transfer period the CAR delivers the administrative file that contains the background of the action that is the subject of the process and that is
in his power.

The environmental license mentioned in the lawsuit and with which the expansion works were endorsed, was issued by the Corporation under the DGEN Resolution No. 20237000994 of December 28, 2023. The project has been the subject of debate because its layout contemplates an intervention of the Thomas Van Der Hammen reserve with the subtraction of 20 hectares of this land.

Galan’s reaction

Through his X account, the mayor of Bogotá, Carlos Fernando Galán, described this situation as “yet another interference by the National Government in matters that must be defined by Bogotá.”

According to the president, the Executive is doing everything to block the possibility of progress in a strategic work for the mobility of Bogotá. “I have said it in several scenarios: the National Government wants to prevent by any means the expansion of Boyacá Avenue. This project is part of the organized development with the necessary environmental compensations that the city requires”he added.

Galán also pointed out that his administration will “everything that is in our hands” so that the autonomy of the city is respected.
