The National Court has searched and captured Fernando Presencia, a former judge convicted several times for prevarication, in addition to sending three of his collaborators to prison without bail, as requested by the Prosecutor’s Office: the far-right Alberto and Santiago Royuela and Juan Martínez Grasa . Presencia, accused of leading a group dedicated to slandering and falsely accusing judges, prosecutors, politicians and journalists, has not appeared and the judge investigating him has chosen to search and capture him.

Judge Gadea understands that it is a “criminal organization” with Fernando Presencia at the “vertex”. The ex-magistrate, expelled from the judicial career after several convictions for prevarication, “would have set in motion a structure exclusively aimed at his own illicit enrichment and that of some of the closest members of the organization through the dissemination of false news.”
For the instructor, all are charged with crimes of fraud, misappropriation and illicit association. Because, according to his suspicions, behind this massive dissemination of false accusations there was an objective of enriching himself with the contributions of the people. “The mendacious complaints against the high institutions of the State, authorities, politicians and other public representatives would be the necessary component to continue with the lucrative activity that such high returns would be giving them,” says the order.
The defendants who have appeared have arrived at the National Court accompanied by a dozen people who carried a banner in their support, some of them disguised as Roman soldiers. Judge Gadea had summoned them to decide if he imposed some kind of precautionary measure on them. The investigator in the case has verified that after a year of investigation they have not stopped making false accusations against judges, prosecutors and politicians and keeping the ACODAP association active.
Alberto and Santiago Royuela, father and son, are the main promoters of what is known as the ‘Royuela File’. A series of documents with which, without any evidence, they have been accusing judges, prosecutors and politicians for decades of belonging to an organization that hides millions abroad and that orders hundreds of murders, including that of one of their relatives. In recent years they have allied with Presencia, along with the one that continues to raise these ‘spam’ complaints that the National Court investigates as false.
Los Royuela and Martínez Grasa have been received at the gates of the National Court by a dozen people, several of them disguised as Roman soldiers, with a banner demanding that the accusations that have been launched for years on the internet be investigated. At the gates of the building, the Royuelas and their lawyer have insisted that all the accusations they are launching and for which they are being investigated are true, presenting hundreds of pages.
For Judge Gadea, however, both his complaints and the ACODAP association were not used to fight against alleged judicial corruption, but would be “the corrupt means through which, apparently, its members and relatives would enrich themselves, starting with its president, Fernando Presencia Crespo, who once separated from the Judicial Career had no income, and that the alleged intention of acting against corruption would be nothing more than a false claim to attract anonymous contributions and donations.
The Prosecutor’s Office had requested the entry into prison of the three for risk of escape, concealment of evidence and that they continue to commit crimes. The investigating judge understood, when he called them to testify, that his criminal activity had not slowed down after a year of investigation and that the time had come to decide if he imposed some kind of precautionary measure. Presencia has not appeared at the Hearing but his investigated association ACODAP has asked his followers for financial help on Telegram this noon.
A judge expelled for corruption
Fernando Presencia obtained great relevance during his time as a magistrate in Valencia until he was sanctioned by the General Council of the Judiciary and sent to Talavera de la Reina, where he began to practice as dean. It was in the town of Toledo where he began his prevaricating career: he was twice convicted for favoring friends and acquaintances from his court in various legal cases.
Presencia then began to denounce not only the corrupt actions of the organizations that had signed their sanctions and sentences, but also of judges and prosecutors. At one point their paths crossed with those of Alberto and Santiago Royuela and the massive complaints against their rivals included accounts in tax havens.
For a year now, Judge Gadea of the National Court has decided to investigate not only this massive shipment of false complaints but also whether the money he obtains from donations through his ACODAP association is being managed illegally.
