The founder of Podemos Juan Carlos Monedero registered a letter yesterday Thursday at the National Court in which he requests the annulment of the order in which Judge García Castellón opened an investigation against him in 2021, after the failure of the case on Podemos. Monedero also requests that the actions that have taken place after 2021 be null and void “for violating his right to defense.”

Monedero’s brief was presented after it was confirmed that the National Court gave the green light to this last attempt by García Castellón to continue investigating the founder of Podemos, thus rejecting the arguments of the former politician’s defense that the judge wants to return to filed facts in a Madrid court and that the new case is part of a prospective investigation.
In the letter, Monedero’s defense denounces that “the right of defense” of the founder of Podemos has been completely laminated, since “they have not had access” to the proceedings. Therefore, they argue, it has not been possible to exercise “none of the rights established in article 118 of the Law of Criminal Procedure.”
According to the defense, this attitude of the Court towards those investigated “contrasts” with the admission of Vox and Pro Lege as popular accusations. Thus they justify that they request this annulment of the proceedings because the procedure is “completed”, there has been “defenselessness” and there is not sufficient reason for the summary secrecy to be decreed.
Investigated for alleged crimes of money laundering and false documentation
In July, before going on vacation, García Castellón agreed to open a case to investigate him for alleged crimes of money laundering and false documents after having failed in the secret and “prospective” case for the alleged irregular financing of training, in which he also prosecuted the politician and other founders of Podemos without even attributing them the status of defendants, as the Prosecutor’s Office and the higher instance reproached the judge of the National Court.
García Castellón is now focusing on some transfers between the Monedero company, Caja de Resistencia Motiva 2 Producciones SL, with the company VIU Europa and Banco del Alba for the preparation of an advisory report on the financial spheres of the Alba countries.
The origin of the case is, moreover, a dossier of the PP political brigade, made in 2016, the content of which the Supreme Court despised and that five years later has been seasoned with some “third-party narratives” by former military officer Hugo ‘El Pollo’ Carvajal . According to the judges of the Criminal Chamber, the former head of Hugo Chávez’s military intelligence only intended to “delay” his extradition to the United States.
