The associations of judges and prosecutors that threaten an indefinite strike as of May 16, in the middle of the electoral campaign, acknowledge progress in their negotiations with the Government but maintain, for the moment, the call for a total strike that they registered through the official channel The last friday. For almost three hours in the morning and an hour and a half in the afternoon, the interlocutors have exchanged proposals that neither party has wanted to make public for the moment. “We are in a negotiation framework and some type of position is beginning to take shape. Right now it is time for study, reflection and assessment of what is on the table, both on one side and on the other”, Judge Juan José Carbonero, who participated in the meeting on behalf of the of the Professional Association of the Magistracy (APM), conservative and majority in the race. Prosecutor Inés Herreros, president of the Progressive Union of Prosecutors (UPF), has assured, for her part, that she is “optimistic” and has stated that it is time for “all parties to be generous” in order to reach an agreement that is satisfactory to all parties.
The negotiation takes place within the framework of the compensation table, the body legally established to review their salaries, since judges and prosecutors do not have the right to unionize or collective bargaining recognized. These professionals complain about the “loss of purchasing power” that they have been “dragging” since 2009 in a context of “increased litigation” that they attribute, among other factors, to a “waterfall of legislative reforms” that has increased their functions ” exponentially”.
For the moment, the call that remains formally registered is seconded by the associations that cover the space of the judicial center-right, which are the majority in both races. They are the Professional Association of the Magistracy (APM), the Francisco de Vitoria Judicial Association (AJFV) and the Independent Judicial Forum (FJI), the Association of Prosecutors (AF) and the Independent Professional Association of Prosecutors (APIF). The Association Judges and Judges for Democracy and the Progressive Union of Prosecutors (UPF) also participate in the table but have not signed the call pending how the negotiations progress.
The strike threat occurs in the context of the great judicial gridlock registered after the lawyers’ strike, which caused the suspension of 350,000 proceedings between trials, statements and other proceedings. These officials managed to wrest from the Government a salary increase of up to 450 euros per month that ignited a fuse that reached all levels of Justice.
Officials from the judicial offices have been holding indefinite strikes for two weeks and have called another seven days of strike during this month of May. The lawyers of the public service have also mobilized. If finally carried out, it would be the sixth strike by judges and the third by prosecutors in the entire democracy. Although the main novelty is that, in this case, the call has been registered as indefinite.
