New York (AFP) – The tycoon Elon Musk was authorized on Wednesday by a United States judge to include among his arguments to desist from buying Twitter the complaints of a former head of security of the social network.
Delaware Judge Kathaleen McCormick, on the other hand, refused to defer the process, as Musk requested, considering that the delay exposes the company to further damage, according to the text of the sentence accessed by AFP.
At the beginning of July, Musk announced that he was breaking the purchase agreement for 44,000 million dollars reached with the Twitter board, accusing the company of not having respected its commitments and not communicating the exact number of fake and spam accounts on its platform. .
Twitter sued to require the businessman to comply with the agreement.
But a former head of security for the social network, Peiter Zatko, accused the company of hiding vulnerabilities in its protection system and lying about its fight against fake accounts. Zatko sent a lengthy document to US authorities in early July but it was only made public in late August.
Musk’s lawyers asked to include the former Twitter employee’s allegations in his defense.
The judge understood that Musk has the right to modify his complaint, although he will not rule on the “merits” or relevance of these accusations, until they have been fully substantiated and counter-argued by the parties.
He again refused to postpone the process, which will then begin as scheduled on October 17 and will last five days.
“The longer the trial takes, the greater the risk of irreparable damage to Twitter,” McCormick said.
The judge pointed out that the firm is currently suffering from the resignation of many employees and “has been forced for months to operate in the midst of the difficulties of a merger agreement rejected” by the purchasing party.
