Double advice with the new pension: who can request it and to whom does it not apply?

One of the relevant issues brought by Law 2381 of 2024 (pension reform) is double advice. This mechanism allows members to make an informed decision about the pension plan that best suits them for their future pension.

Members who meet the requirements set out in Article 76 may attend this double advisory service to access the transfer opportunity, and those members who are in the transition regime provided for in Article 75.

María Lorena Botero, Pension Benefits Manager at the Porvenir Administrator, explains that the information that the member must receive during the double consultation includes the projection of the pension benefit that he or she will receive at retirement age, based on his or her current situation and simulations with different contribution densities to analyze future job stability.

The Porvenir board says that according to the new law, those who are eligible for the transfer opportunity will have two years from July 16, 2024, the date when the law was enacted, to make use of this mechanism and make a duly informed decision about their pension future. In this consultation, experts from both regimes will explain in detail the characteristics and benefits of each one.

It must be remembered that Members in this group must meet the following conditions by July 16, 2024: have 750 weeks of contributions, in the case of women, and 900 weeks of contributions, in the case of men, and be less than 10 years from retirement age. Members to whom the transitional regime applies will continue under the conditions provided for in Law 100 of 1993, and may therefore change pension regimes before 10 years of reaching retirement age, as follows: women at 47 years of age and men at 52 years of age.

New pension law – Law 2381 of 2024

Those who are covered by the new law, that is, workers who, as of July 1, 2025, have less than 750 weeks of contributions, in the case of women, and less than 900 weeks of contributions, in the case of men, do not need to take the double consultation. This group will retire under the conditions of Law 2381 of 2024.

What is the procedure for double counseling?

The worker must contact Colpensiones and the pension administrator where he or she is affiliated. Both entities must provide clear and precise information on each pension plan so that the affiliate can make an informed decision. It is important to note that double counseling is free of charge for the applicant and does not require the assistance of a third party.
