The position that has been firm, both on the part of ByteDance and on the part of the Chinese government, is not to sell the platform to an American company. Even officials have highlighted that if they try to do so, this measure would be blocked.

From Beijing, the argument for stopping the operation would be because it represents a violation of its technology export laws, which prohibit other countries from having access to algorithms or source codes of their applications.

Furthermore, it is important to remember that the government owns the so-called ‘golden share’ in ByteDance, a mechanism that gives it influence over the company’s strategy and operations even outside the country.

The reason why the Biden administration decided to give way to the law that would ban TikTok in the United States, which gained bipartisan support, is because it has been accused of espionage and political manipulation.

However, the company has repeatedly denied the influence of the Chinese Communist Party and has stated that this law will violate the First Amendment free speech rights of its users.
